Fundamentos filosóficos de los derechos en la Constitución ecuatoriana de 2008
Análisis crítico desde las dimensiones humanas.
Abstract
La Constitución ecuatoriana de 2008 se expidió con la oferta de ampliar el catálogo de derechos constitucionales. Sin embargo se excluyen de su texto las dimensiones del ser humano y se sustituye a la persona natural con el Estado. En este trabajo se estudiará las definiciones que plantea Juan Fernando Sellés para identificar cuáles son los fundamentos de los derechos en la Constitución ecuatoriana de 2008 y qué lugar ocupa la persona humana en este debate teórico.
